Charles, while I may not understand what is going on fully, what you are doing is not only Immoral, but is also Illegal.

You are taking his INTERLECTUAL property and twisting and distorting it for your own personal gain.

If you want to tell a story from the ASB point of view, you first need:

* Consent from all persons and characters you wish to portray in it.
* A original idea, including a name.
* Less than 20% copied from existing literature in total. (as this is a Fan Fiction, the works of the pokemon universe would be considered exempt from this rule.)

This is coming from a legal stand point (International copyright law).

WITH that being all said, YES, you can write a story about ASB. But it has to be original. It can include any character that has given you consent to use their name, likeness, mannerisms, ect. It can include ELEMENTS (with permission) that were present in the original story (I have not read any FF on this forum). AND it can mention events of previous FF ONLY if you have the consent of the writers.

Maybe I should try writing a FF...

Charles, Chris has made it very clear that he doesn't feel comfortable with you publishing this idea of yours on the forum. You can write it all you want -- no one's saying otherwise. But if you try to show it off here, then we have every right to delete it and infract you.

It's true that Chris never got permission to use our own likenesses in his fic, but if anyone had a problem with it, then it would've been on us to say something to him, and it can assumed that he would have done the reasonable thing and write us out. You, however, seem very unwilling to compromise whatsoever.

As a result, I'm asking you not to bring this up in the ASB forum again. If you fail to do so, then your posts will be deleted.

This is a response, in whole to some of the stuff that's happened apparently while I'm not on, regarding copyright and such. Granted the drama has passed and I'm just now catching up on it.

Ayuen: You are correct (except it's Intellectual, not IntERlectual) property. However, things on the internet (Fan Fic's included) aren't subjected to instant Copyright and, sadly, are under Public Domain for issues of copyright under the Digital Millennium Copyright Act (unless subject to specific forum and social networking guidelines). And things in the public domain can be used, modified, and such. Those that aren't in public domain are subject to modification so long as they are for strict, educational, non-profit, references for making a point relevant in an electronic discussion and a disclaimer is shown stating that the material being used is not owned by the poster (there was a huge thing about this on You Tube where some people were flagging videos for violating DMCA laws when the videos were under Public Domain and were modified as part of a response to another video, and in many cases the ones filling the DMCA's did NOT own the copyright on the videos they were flagging).

To be fair, Charles has every right to modify and continue Chris' ASB Fan Fic as it is his own, since it's under Public Domain. However, according to the TPM Rules and regulations, He cannot do so without explicit written permission from Chris (who owns, in a sense, the intellectual property but is not Copyrighted because he doesn't own the source material [Pokemon/ASB]). When I was writing fan fiction and I found a character I liked from another FIc, I would ask if I could use the character in mine (and often met with "No") which was fine and showed respect between artists.

Yes, Chris did use our likenesses in the Fic (I even asked if he would do mine, flatery and all that ) However he didn't get to it. The fic was popular and as Grey stated, if any of us had an issue with it or the way we were portrayed, showing the author enough respect and asking to be either written out or get some character development would be the correct path to take.

Just my take on it.
