No but then again I am not defending Bush's use of the PATRIOT act, you are the one that brought it up. Not to mention the Patriot act was created by Congress, during a time of extreme fear that caused them to pass it with fear. There is absolutely no excuse with this.
I wouldn't hold your breath.
This... has to be one of the most idiotic statements you have ever made. Either that or you are unaware of police interrogations in the United States. Yes a man has the right to remain silent, during that time the Police can hold him in a small room for 20 or more hours, they can intimidate him or her, they can tell mothers that they will lock them up so that they will never see their children again. They can tell men that they are going to put them in jail and inform the jail that he is a child rapist so that he gets killed in prison. They can use any number of tactics to get the man to talk.
Which is why this law is so very important. That the lawyer protects the person from this kind of questioning. The police are tasked with getting a confession out to use at trial. They will do everything they can to bring about that confession.
This isn't to bring about a concrete law though, this is to over turn the law to allow abuse to happen. Not to mention this ruling pretty much is to provide teeth to a law already in effect called the Miranda Rights.
